Backstory : My dad is having an external affair and wants to divorce mom..
Dad is threatening to take our house on divorce . The house is currently in mom’s name. Yes there are other properties in name of my dad too. In my mom’s name it the house and one small piece of land. Can he take house from divorce?

  1. Will be split among family members equally . If cheating prove garna sakinxa court ma ( against dad) vane chai , mom side can be preserved (no split) and dad side will be split equally among family members . I pray for you brother 🙏. Stay healthy.

  2. All property in your father’s and mother’s name will be divided among the family meaning it will be split among your father, mother, you and your siblings if any. There is no way your father will end up with all the properties.

  3. Find proof of your dad’s external affai. That will give you a massive advantage in the case.
    I am no lawyer so take this with a grain of salt.

    From what i have heard, if a woman has an external affair, and the husband can prove it, he can walk out of a divorce without sharing any of his property. Im sure there is a reciprocal clause too. If you can prove his affair, you’ll walk out of the divorce with a favourable judgement.

  4. ALL Property will be divided equally. If your mother does not have income source and prove the Father’s affair, Mother will also get the regular compensation from the father.

    Nepal’s law is quite favourable to the female side, so you do not have to worry much.

  7. Your father can’t do that. Your mom has equal rights on your father property. Just don’t file a divorce case first without evidence. Women case are strong if they have a child.

  10. Try proving your dad is cheating. Hire personal Investigators and find women that your dad cheated with. Try to find evidence your dad cheated an consult a lawyer before a case on how you can prove your dad cheated and how to collect evidence.

    – ur dad kicks ur mum out of the house or hasn’t provided food and shelter (national civil code, section 95, subsection b)
    – ur dad mutilates ur mum or does anything that causes physical or mental problems or has any plans to do so
    (civil code, sec95, subsec-c)
    – ur dad has sexual relations w anyone and is proved
    (civil code,sec95, subsec-e)
    also your dad has to do a property division before the divorce proceedings which will automatically put your mum’s name in some properties.
    Nepal’s divorce laws are in favour of women so ur mum has an advantage!!

  12. Someone told me that the female’s property is not divided on divorce. I found it to be unbelievable, so don’t quote me on that. But, do check out if it is true.
