Will you have to pay alimony even if the wife is cheating?

So my relative discovered recently of his wife cheating. They haven’t been talking to each other and she has moved to her maita. He is considering a divorce but they have a significant amount of property and many are in her name(kti ko naam ma rakheko so they gotta pay less tax and stuff). How will the division of property be like? Will she get to keep it? and what about the rest that is in his and his parents name? Will it also get divided? He has no kids. Evidence he has are some text message and video footage from door camera of the dude and her entering their house. Also is there any nice family lawyer in birgunj area?

  1. i think its going to be pretty bad for the guy dude. The laws in nepal are pretty lopsided. They might split both of their properties equally i guess if the guy can prove he gave it to her. But what happens in general is the girl keeps everything she has and the guy gives 50% of what he has to the girl. But most of these cases dont have the whole guy gave some gift scenario so.

    Lmao. I mean, thats her property now. You can take her to court but they’ll be admitting to tax fraud..

    I dont think there’s anything about infidelity in divorce laws. Even so.. the property is in her name.

  3. If you can prove she cheated, husband will not have to share property. Idk about properties in wife’s name but proof vaye he will have the upper hand.

    Tip: Get a lawyer asap and gather proof. Ra from next time, dont waste diamonds on a hoe.

Well yes Kti KO name ma vako property will be hers Tara if they want to go to court to take back the property , tax fraud will be a major question but it will be a lot cheaper than, losing the whole property even though, there can be establishment of family to family property transfer so if they could prove that their house was of his family by showing the transfer papers from past and who’s name was it in it can be a long run but can hold some chances to get the house back and the land if it was also in name of his family before .

  5. I have a very simple and extremely effective “Trick” to resolve this. But i cannot say this here i don’t want to get in any kind of legal trouble hehe.. But i will give a hint body + bag + dump. If you are smart enough to decipher this you can pull it off.

  7. As long as i know, it depends on who files the divorce. Kta le file garyo bhane tiraucha but kt le file garyo bhaye you’ll have some grounds. In simple words, kta le fule garyo bhane chai kt lai bichalli parera sadak ma lyayo typ ko argue garna sakcha. Better get a good lawyer before you file anything. Similar thing happened to my cousin and he gave some of the property and 25 lakh cash only because we filed the case and argument nai bihe garera barbard paryo typ bhako thiyo. In reality girl fell in love with her manager and wanted divorce

  8. In certain cases the husband will not be required to pay maintenance or alimony (if he has no earning capacity for example). In addition in certain fault-based cases the wife may lose any claim she has to a husband’s property on divorce.
    Prove that the guy went to depression after he found wife cheating, which caused his business loss/loss of job.

Indian lawyer ko video ma herya thiye so nepal ma pani milla. Divorce cases haru ma guys are at a disadvantage but ramro lawyer xa vane most property bachauna milxa. Hope the guy gets justice.

Divorce hune bela both wife and husband ko property total garera partition chai huncha so even if wife ko naam ma dherai property vaeni she won’t be able to keep it all to herself except if property usko naam ma before marriage thiyo or usko maiti le deko vane. Ani since adultery ko kura ni aunu sakcha divorce huda so je ni hunu sakcha.
