How come Tiktok ban garni jasto impactful decision, within short period of time and so easily approve and execute bhako. Isn’t there any sort of check and balance system in place to debate, contest and amend these decisions?

UML ko government huda, government easily banned porn. Of course, nobody cared to enforce it after some time. It’s a political move. If China cares enough, it will not happen. Guess we wait and see. But looking at the coverage it’s receiving, I think China will care. In that case, someone will complain to the supreme court saying it is unconstitutional, the court will agree, and everyone will start pretending it never happened.

Govt can do almost anything unless they are stopped by the Courts. I mean they released someone for cruel murder but supreme Court overturned it.
Now this decision to ban tiktok is done via a Cabinet decision and so far I haven’t seen any specific laws mentioned that allows Govt to do this, so Supreme Court may see this and overturn this ban. After all Tiktok is a media platform in a way and the Court will also see whether this easy ban of tiktok will set a bad precedent and it will allow Nepal govt to ban almost anything, including media websites and newspapers.

basically the executive mantirmandal can make decisions based on laws that are already in place. there is a law against hate speech, vulgarity. they have based their ban on this law. timle vaneko jasto kura chai aba social media bill vanne propose vako cha jun chai legislative bata pass hunu parcha.
but the thing is, there are also laws protecting free speech and democracy. so this matter will be taken to the supreme court and the verdict depends on how the court interprets it. it can say that this ban is against free speech and therefore unconstitutional so it has to be reverted. or it can say that tiktok indeed is promoting vulgarity, instigating violence and hate, and therefore the ban is justfied.
as per my opinion, for pornographic content prohibition there was a law already in place for prohibiting “अश्लिल सामग्री”. but tiktok ban is different. they haven’t mentioned as per which law this was banned. they have just blatantly stated that it disrupts social harmony. so as per the constitution, this ban is legally void.
